A contractor will be responsible for conducting a literature review, gathering qualitative data, and providing input for a report that NCD staff will draft. This report aims to examine the historical development of guardianship laws, assess their compatibility with the civil rights advances of the disability community, particularly the Americans with Disabilities Act (ADA), and explore potential reforms or alternatives to guardianship that align better with ADA goals.
The project will analyze how guardianship laws have been influenced by international standards, such as the Convention on the Rights of Persons with Disabilities, and assess the impact of guardianship on individuals with disabilities, particularly concerning their rights to self-determination. In addition, the report will offer policy recommendations to help align guardianship systems with the principles of the ADA.
The estimated contract period is twelve months, with specific deadlines for deliverables that will contribute to the final report.
