If applying as a Bona Fide agent of a state government, a letter from the state government as documentation of the status is required. Place this documentation behind the first page of the application form. To be eligible for an award under this program, an applicant shall demonstrate that it has enacted a State statute, or has amended an existing State statute, that meets the requirements specified in title XIV Pool and Spa Safety Bill (15 U.S. C. 8001), Sections 1405 and 1406 of the Virginia Graeme Baker Pool and Spa Safety Act. The Act can be accessed at www.poolsafety.gov/pssa.pdf. States must have received a letter of advice from the U.S. Consumer Product Safety Commission s Office of the General Counsel to verify that the applicable state statute meets CPSC s technical guidance. A copy of the applicable state statute and the CPSC letter of advice should be included as an appendix to verify state eligibility.
