Subcontracts, if any, must be awarded in accordance with 29 CFR 95.40 48, including OMB circulars requiring full and open competition for procurement transactions, to the maximum extent practicable. A 501(c)(4) nonprofit organization, as described in 26 U.S.C. 501(c)(4), that engages in lobbying activities will not be eligible for the receipt of Federal funds constituting an award, grant or loan. See 1 U.S.C. 1611. Applicants other than State or local government supported institutions of higher education will be required to submit evidence of nonprofit status from the Internal Revenue Service (IRS).
