Opportunity Summary:

The Tribal Self Governance Program Negotiation Cooperative Agreement is a discretionary funding opportunity from the Indian Health Service (IHS) designed to help federally recognized Tribes move into, or further expand within, the Tribal Self Governance Program (TSGP). The core goal is to support negotiation work that allows Tribes to take on greater control over health-related Programs, Services, Functions, and Activities (PSFAs) that would otherwise be administered through IHS. This opportunity specifically targets three situations: Tribes that are not yet participating in TSGP and need support to begin negotiations to enter; Tribes that previously received negotiation funding and need additional support to continue negotiations toward entry; and Tribes that already entered TSGP after receiving prior negotiation support and now want to negotiate for new or expanded PSFAs.

The award mechanism is a cooperative agreement, meaning IHS expects to have substantial involvement with recipients during the project rather than simply issuing a grant with minimal federal engagement. The funding activity category is health, and the CFDA listing tied to the program is 93.444 (Tribal Self Governance Program Planning and Negotiation Cooperative Agreement). The total estimated funding amount is $240,000, with an expected eight awards. Each award is fixed at $30,000 (both the floor and the ceiling), and there is no cost sharing or matching requirement, which can make participation more feasible for Tribes that want to focus resources on the negotiation process itself.

Eligibility is limited and defined in several parts. Applicants must be federally recognized Indian Tribes that fit one of the program’s negotiation pathways: either they have never received a Negotiation Cooperative Agreement before, they previously received one but did not enter TSGP, or they received one, entered TSGP, and now seek to negotiate assumption of additional or expanded programs. Applicants must meet the definition of an Indian Tribe under 25 U.S.C. 450b(e). The announcement also includes Alaska-specific limitations: Alaska Native Villages or Alaska Native Village Corporations are not eligible if they are located within an area served by an Alaska Native regional health entity that was already participating in the Alaska Tribal Health Compact in 1998. In addition, certain entities (the Native Village of Eyak, Eastern Aleutian Tribes, and the Council for Athabascan Tribal Governments) are identified by statute as Alaska Native regional health entities. At the same time, the opportunity notes that Alaska Tribes not represented by a Self-Governance Tribal consortium funding agreement within their area may still be considered eligible, which suggests IHS intended to preserve access for Tribes not already covered through an existing regional compacting structure.

The application package must include formal proof of Tribal authorization. A Tribal resolution is required from the appropriate governing body of each Indian Tribe to be served, authorizing submission of the application. If a Tribal consortium applies, resolutions must be provided from each member Tribe in the consortium. Beyond governance authorization, applicants must also demonstrate financial stability and strong financial management capability over a three-year period. Specifically, the Tribe must show no uncorrected significant and material audit exceptions in the required annual audits of Indian Self-Determination Contracts or Self-Governance funding agreements with any federal agency. To document this, applicants are required to submit complete annual audit reports for the three fiscal years prior to the year of application, making audit readiness and clean findings a central gatekeeping requirement for participation.

Key administrative details from the announcement include the funding opportunity number HHS 2011 IHS TSGN 0001 and a posting date of August 12, 2011. The original and current closing date listed is September 3, 2011, and the archive date is October 3, 2011.
