The NFP describes how applicants must demonstrate that a participating LEA meets this statutory definition of high need LEA (69 FR 24002, 24006). Pursuant to the NFP, we provide the following supplementary information regarding the data an applicant uses to demonstrate eligibility as a high need LEA under this competition As described in the NFP, absent a showing of alternative LEA data that reliably show the number of children from families with incomes below the poverty line that are served by the LEA, the eligibility of an LEA as a high need LEA under component (a) of the definition must be determined on the basis of the most recent U.S. Census Bureau data. The Department examines the eligibility of any LEA not listed on these charts on a case by case basis.
